General terms of use

Items are sold and delivered by The trustee for Crash Holdings Family Trust (ABN 52494377084) trading as Munk Pty Ltd.

Munk Pty Ltd started in 2009 and distributes quality product throughout Australia.  Our warehouse & showroom is based in Melbourne.

All prices are quoted in Australian dollar, and include all taxes.

Goods are shipped by Auspost, with tracking number.

Please read these terms and conditions carefully. These are the terms that will govern any contract between you and us for the sale of the products displayed on this web site. We reserve the right to amend these terms when necessary.

Please note that it is your responsibility to check that your order is correct, and to accurately supply all relevant information necessary to complete the order as requested.

We are under no obligation to accept your order but will normally do so where the items are available, the order reflects current pricing and your credit card payment is approved by your credit card company. Your order represents an offer of contract from you only and is not binding until we have sent you an e-mail confirming receipt and acceptance of your order.

We are entitled to withdraw from any order in the case of obvious errors or inaccuracies regarding the products or the order appearing on our web site.

Placing an order is notification of your acceptance of these terms and conditions. In the rare circumstance that a product price has increased between the time of the order and our acceptance of it (or, again rarely, if an additional delivery charge needed to be applied or the delivery charge amended), we will e-mail you to advise of the change. Your card will never be charged with an amount additional to your original order without your prior written consent. You will, of course, have the right to cancel your order and receive a full refund as per our returns & refunds policy.

Any contract between us will be governed by Australian Law and will be subject to the jurisdiction of the Australian Courts. All of the copyright in the material, documents, site design, graphics, systems, codes and connections contained on this web site or linked to it and the selection and arrangement thereof are owned by Munk Pty Ltd., the web site designers or the publishers of those sites to which this web site links. All rights are reserved. You are entitled to electronically copy and to print sections of this web site for the sole purpose of placing an order with Munk Pty Ltd. Any other use of material on the web site, including photocopying, modifying and/or distributing any pages printed from this web site for purposes other than those noted above, without our prior written consent, is strictly prohibited.

We will attempt to ensure that the information available on our web site at any one time is accurate but cannot guarantee that it will be fault-free. Our web site is provided on a 'as is' and 'as available' basis. We are not liable to you if we cannot supply a particular item. If you would like us to deliver substitute lines should selected products be unavailable, then you can request this when placing your order.

We do not make any warranties that the web site is secure or is free from infection by viruses or anything else that has contaminated or disruptive properties. We do not accept liability for any errors and omissions and reserve the right to change information, prices and descriptions of listed goods at any time. From time to time certain products may vary in style and material to that shown on the web site. We would do our best to correct errors and omissions as quickly as practicable after being notified of them.

We do not accept any liability for any losses or claims arising from any inability to access our web site or any failure to complete a transaction. Our total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation or otherwise, arising in connection with the supply of products or contemplated supply shall be limited to the total price of the products purchased in respect of any claims.

We will not be liable for any indirect or consequential loss (whether for loss of profits, loss of business, depletion of goodwill or otherwise) or damage of any kind in contract, tort or otherwise arising out of the use of the web site or use of the products or services.

You acknowledge that it is not usually possible to detect from inspection of an internet transmission whether the original of it had been forged, wrongfully altered or otherwise misused or where the transmission details such as name of sender, sender's e-mail address, or date and time of transmission imprinted on it automatically are genuine, and you therefore agree to indemnify us against any actions, proceedings, damages, costs, claims, demands or losses whatsoever arising from your so acting, obeying or otherwise dealing in accordance with any such Internet transmission appearing to have been so furnished by you or on your behalf in the event that the said Internet transmission has been produced by forgery, wrongful alteration or other misuse of the original transmission or that said transmission details appear on it are not genuine.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence or fraudulent misrepresentation.

These terms and conditions do not affect your statutory rights.

Product prices & GST

All prices are shown in Australian Dollars, the currency in which all transactions are processed.

All product prices are shown inclusive of GST and shipping. 

Methods of payment

When purchasing through our Online Shop you may use apple, google or shop pay, credit/debit cards (Visa/Mastercard/AMEX) or PayPal. We do not accept cheques. If you would like to use another payment method (e.g. business account) please contact us to make the necessary arrangements.

 

Delivery prices & policies

Orders placed using this Online Shop can currently only be shipped to addresses within Australia.

Delivery charges (including GST) are calculated as follows:

For order values up to $15, delivery is $9.95
For orders from $15.01 - $50, delivery is $15.00
For orders from $50.01 - $100, delivery is $25.00
For orders from $100.01 - $150, delivery is $30.00
For orders from $150.01 - $200, delivery is $40.00
For orders from $200.01 - $250, delivery is $50.00
For orders from $250.01 - $300, delivery is $60.00
For orders from $300.01 - $350, delivery is $70.00
For orders from $350.01 - $400, delivery is $80.00
For orders from $400.01 - $450, delivery is $90.00
For orders from $450.01 - $500, delivery is$100.00
For orders from $500.01 - $550, delivery is $110.00
For orders from $550.01 - $600, delivery is $120.00
For orders from $600.01 - $650, delivery is $130.00
For orders from $650.01 - $700, delivery is $140.00
For orders from $700.01 - $750, delivery is $150.00
For orders from $750.01 - $800, delivery is $160.00
For orders from $800.01 - $850, delivery is $170.00
For orders from $850.01 - $900, delivery is $180.00
For orders from $900.01 - $950, delivery is $190.00
For orders from $950.01 - $1000, delivery is $200.00

If your order value exceeds $1000 please contact us directly for a shipping quote.

The 77 and 145 litre boxes are only available for pick up from our Victorian warehouse. If you require shipment of these items please contact us directly for a shipping quote.

Subject to this agreement, we will supply to you the products shown on your order confirmation.

Delivery timescale

We dispatch between 1-3 business days after receiving an order.  Whenever possible we use Australia Post for shipments which are less than a meter in length.

Australia Post timeframes from our warehouse are generally as follows:

Brisbane, Sunshine Coast, Gold Coast, Hobart 3-8 Days

Rest of Australia 6-14 Days

You understand that we will use our best endeavours to meet stated timeframes for dispatch and delivery, however many factors can affect these timeframes and we cannot guarantee that they will always be met.

Pick up

  • Orders must be raised and paid for online.
  • There are no handling fees associated with pick up in person.
  • Pick up can occur on receipt of invoice.

All orders are available for pick up, Monday to Thursday 9am to 3pm but please note that our office and warehouse are open to the public by appointment only. If you intend to collect an order in person, or to visit us for any other reason, please contact us first so that we can ensure appropriate staff are available.

Orders not picked up within 28 days from date of the invoice will be credited (upon written request), excluding bank charges.

Amending or cancelling an order

Unfortunately, we are unable to accept any amendments to orders once they have been placed.

  • Cancelling an order before it is shipped
    If you decide you need to cancel your order before it has been shipped, please contact us as soon as possible.

There is no charge or penalty for cancelling your order prior to despatch.

  • Cancelling an order after it is shipped
    If you decide you need to cancel your order after it has been shipped, you must contact us within 7 working days following the delivery of the order.  We cannot accept change of mind returns on items that come in sealed packages or boxes where seals are damaged or broken.

Please note that after an order has been shipped you will not be refunded any shipping fees.

We will make any necessary credit card refunds only after you have returned the items to us in original condition. We cannot be held responsible for items lost or damaged during their return to us, so you may want to consider sending them via an insured service.

Whilst there is no administrative charge or penalty for cancelling your order after despatch, please note that we will not cover the cost of returning items to us unless they were defective or you received the wrong items (see Returns & Refunds). 

 Refund Policy

This Refund Policy ("Policy") applies to the following purchases:

1.  General

We offer refunds, repairs and replacements in accordance with the Australian Consumer Law and on the terms set out in this Refund Policy ("Policy").

Any benefits set out in this Policy may apply in addition to consumer's rights under the Australian Consumer Law.

Before making a purchase, please read this Policy so that you can understand your rights and what you can expect from us if you are not satisfied with your order.

2.  Australian Consumer Law

Under the Australian Consumer Law:

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the goods, you are entitled

- to cancel the purchase; and
- to a refund for the price of the goods; and
- compensation for any damage or loss (whether direct or consequential) that was, or reasonably ought to have been, foreseeable by us.

If the failure with the service does not amount to a major failure, you are entitled to to a re-supply of the goods within a reasonably time, or to cancel the purchase and be provided with a refund of any price paid.

We offer refunds, repairs, and replacements in accordance with the Australian Consumer Law.

The Australian Consumer Law provides a set of Consumer Guarantees which protect consumers when they buy products and services.

If the Australian Consumer Law applies, then we cannot avoid the Consumer Guarantees which it provides. If there is an inconsistency between this Policy and the Australian Consumer Law, the Australian Consumer Law will prevail.

Further information about the Australian Consumer Law and these Consumer Guarantees is available from the website of the Australian Competition and Consumer Commission.

If a product or service which you purchased from us has a major failure (as defined in the Australian Consumer Law) then you may be entitled to a replacement or refund. You may also be entitled to compensation for any reasonably foreseeable loss or damage resulting from that major failure.

If a product or service which you purchased from us has a failure which does not amount to a major failure (as defined in the Australian Consumer Law) then you may still be entitled to have the goods repaired or replaced.

3.  Cancellation and Change of Mind

Cancelling an order before it is shipped

If you decide you need to cancel your order before it has been shipped, please contact us as soon as possible.  There is no charge or penalty for cancelling your order prior to despatch

Cancelling an order after it is shipped

If you decide you need to cancel your order after it has been shipped, you must contact us within 7 working days following the delivery of the order.  We cannot accept change of mind returns on items that come in sealed packages or boxes where seals are damaged or broken.

4.  Products Damaged During Delivery

In the event that the product you ordered has been damaged during delivery:

- Please contact us as soon as possible.
- Any damaged product must be returned in the condition in which it was received, together with any packaging and other items which you received with the damaged product.
- We will arrange to repair or collect the damaged product and replace it with an equivalent product, or to refund it, provided that you have contacted us within days from the date of receiving the product.

5.  Exceptions

Notwithstanding the other provisions of this Policy, we may refuse to provide a repair, replacement or refund for a product or service purchased by you if:

You misused the said product in a way which caused the problem.

You knew or were made aware of the problem(s) with the product or service before you purchased it.

You asked for a service to be done in a certain manner, or you asked for alterations to a product, against our advice, or you were unclear about what you wanted.

Any other exceptions that apply under the Australian Consumer Law.

6.  Shipping Costs for Returns

In the event that a product you have purchased fails to meet one or more Consumer Guarantees under the Australian Consumer Law, we shall bear any cost of shipping the said product (the "Returned Product") back to us, as well as any cost of shipping any replacement product to you.

If the Returned Product can easily be shipped or returned, then you are responsible for organising for the Returned Product to be returned to us. If the Returned Product is eligible for a repair, replacement or refund under the terms of this Policy (including under the Australian Consumer Law) then we will reimburse you for the reasonable postage, shipping or transportation costs for the Returned Product.

If the Returned Product is too large, too heavy, or otherwise too difficult to be removed and returned by you, and is believed to be eligible for a repair, replacement or refund under the terms of this Policy (including under the Australian Consumer Law), then we will organise for the postage, shipping, transportation or collection of the Returned Product, at our cost.

In the event that we organise and pay for the inspection, postage, shipping, transportation or collection of a Returned Product, and it turns out not to be eligible for a repair, replacement or refund under the terms of this Policy (including under the Australian Consumer Law), then you will be required to pay the costs of any inspection, postage, shipping, transportation or collection of the Returned Product.

7.  Response Time

We aim to process any requests for repairs, replacements or refunds within days of receipt.

8.  How to Return Products

You can contact us using the contact email provided at the end of this Policy to discuss a return using the information.

Unless otherwise defined in our sole discretion, we shall pay all refunds in the same form as the original purchase or to the same account or credit card used to make the original purchase.

To be eligible for a refund, repair or replacement, you must provide proof of purchase.

You may be required to provide a government issued identification to qualify for a refund, repair or replacement.

Complaints

If you have any complaints about our Online Shop, our service, or our products please contact us as soon as possible so we can sort things out.

 

Privacy

We do not collect personal information if you only browse this website.

When we do collect personal information, it is our usual practice to collect this information directly from you. Personal information may include your name, postal address, telephone number and email address.

Our server may log details about any computer used to access the website (such as the IP address, operating system and browser type), the date and time of access, and details of the information downloaded.

We only use your personal information for the purposes for which you give it to us and for internal management purposes. You agree to us using your email address to send you messages for the orders you place and (where you have opted in to receive it) information generally about the products sold by us and/or related websites operated by us or out related entities. If you would prefer not to receive promotional or other material from us, please let us know and we will respect your request.

We do not give information about you to government agencies, organisations or anyone else unless one of the following applies:

  • you have consented;
  • you would expect us to;
  • it is required or authorised by law;
  • it will prevent or lessen a serious and imminent threat to somebody's life or health; or
  • the disclosure is reasonably necessary for law enforcement.

You may request us to remove your personal information from our database by contacting us.
